Terms and Conditions
Effective Date: September 1, 2026 · Last Updated: September 13, 2026
1. Introduction & Nature of Platform
Welcome to XchangeCar ("we," "our," or "the Platform"). XchangeCar provides an online marketplace and matchmaking service connecting vehicle owners interested in peer-to-peer automotive exchanges and swaps.
Important Notice: XchangeCar is a technology platform and communication venue, not an automobile dealer, broker, escrow agent, or financing institution. We do not own, buy, sell, inspect, warranty, or take possession of vehicles listed on the Platform.
2. User Eligibility & Account Integrity
To list a vehicle or propose a swap on XchangeCar, you must:
- Be at least 18 years of age with a valid driver’s license.
- Be the legal, titled owner of the vehicle you list, or an authorized representative.
- Provide accurate, truthful contact and registration information and verify your email address.
- Maintain the confidentiality of your account credentials. You are solely responsible for activities conducted through your account.
3. Listing Accuracy & VIN Verification
Honesty is the foundation of peer-to-peer exchanges. When posting a vehicle listing, you agree that:
- The 17-digit Vehicle Identification Number (VIN) provided is accurate and belongs to the exact vehicle offered.
- The odometer mileage, vehicle condition, maintenance history, and title status (Clean, Salvage, Rebuilt, Lien) are accurately declared.
- Any material defects, mechanical issues, body damage, or open recalls known to you must be disclosed in the vehicle description.
- Photos and media uploaded must be authentic, recent representations of the actual vehicle.
4. Swap Negotiations & Legal Title Transfer
When two parties agree to execute a vehicle exchange, both parties acknowledge and agree:
- In-Person Physical Inspection: All trades must be preceded by an in-person physical inspection, independent pre-purchase inspection (PPI), and daylight test drive at a safe public location (such as a police station safe-exchange lot).
- Title & Lien Verification: Both parties must inspect the physical certificate of title to verify clean ownership, absence of unreleased bank liens, and matching VIN before signing.
- State DMV & Tax Compliance: Users are solely responsible for signing and notarizing titles, executing State Bills of Sale, surrendering license plates, and paying any applicable state sales, excise, or transfer taxes to their state Department of Motor Vehicles (DMV/BMV/MVA).
- Cash Adjustments: Any supplemental cash payment exchanged to balance valuation differences is strictly negotiated between the two trading parties.
5. Market Valuation Disclaimer
The vehicle valuations, trade power ratings, and comparative estimates provided on XchangeCar are algorithmic approximations based on public VIN decoding, MarketCheck data, and historical sales trends. They are provided for informational benchmarking only and do not constitute a guaranteed appraisal, purchase offer, or insurance valuation.
6. Prohibited Activities
Users may not:
- List stolen, fraudulent, cloned, or lien-encumbered vehicles without disclosure.
- Use automated bots, web scrapers, or scripts to harvest user data, valuations, or phone numbers.
- Harass, defraud, or solicit other users for services outside automotive exchange.
- Circumvent security controls, rate limiters, or spam protections.
7. Limitation of Liability & Indemnity
To the fullest extent permitted by law, XchangeCar, its operators, and affiliates shall not be liable for any direct, indirect, incidental, punitive, or consequential damages resulting from peer-to-peer exchanges, vehicle mechanical failures, undisclosed liens, title disputes, or personal injury occurring during test drives or transactions. You agree to indemnify and hold harmless XchangeCar from any claims arising out of your breach of these terms.
8. Contact & Inquiries
